Terms and Conditions for QR ④ LIVE

1. Provider and scope
These Terms govern the digital services at qr4.live provided by Julius Ziesmann, sole proprietorship, trading as QR ④ LIVE (“Provider”). Full details are in the Legal Notice. Conflicting business terms apply only after express acceptance in text form. Mandatory consumer protection remains unaffected.
2. Services
Depending on the plan, QR ④ LIVE provides dynamic QR codes, destination management, mobile profile and content pages, file and media functions, and usage statistics. The plan description shown at checkout defines features, limits and prices. Dynamic codes rely on a Provider-hosted redirect or page and require an active account, suitable plan and service availability. Static QR codes are not offered through QR ④ LIVE. A second, completely free and legally independent service is available for this purpose at alpha-qrcode.com.
3. Account and contract formation
Account features require accurate and current registration information. Credentials must remain confidential and suspected misuse reported promptly. A paid contract is formed when the user clearly confirms the paid order and payment is successfully authorised through Stripe. Input can be corrected before final confirmation and an electronic contract confirmation is provided.
4. Free plans and trials
Free plans and trials are limited to their stated features and limits. At the end of a trial, the account may move to the available free Starter plan unless a paid plan was ordered. A free trial never becomes paid without an express order. Free services may be changed or discontinued prospectively with reasonable notice; accrued statutory rights remain unaffected.
5. Prices and payment
The prices, billing interval and tax information displayed immediately before ordering apply. Stripe processes payments. Users must maintain valid payment details. Following notice, paid functionality may be reasonably restricted for failed or overdue payments where legally permitted.
6. Term, renewal and cancellation
The term and renewal interval are shown before ordering. Subscriptions renew for the displayed interval until cancelled and can be managed through the account or Stripe Billing Portal. Ordinary cancellation takes effect at the end of the paid period, with access continuing until then. Termination for cause and mandatory statutory rights remain unaffected. Unless required by law, no pro-rata refund is due for a partially used billing period.
7. Consumer withdrawal rights
Consumers generally have a statutory right to withdraw from a distance contract. The withdrawal instructions supplied at checkout govern the period and procedure. Statutory rules on requesting early performance of a digital service and their consequences remain applicable. These Terms do not restrict statutory withdrawal rights.
8. User content and duties
Users remain responsible for their content, files, destinations and legality. Prohibited uses include unlawful, deceptive, harmful or discriminatory content, phishing, malware, spam, infringement of intellectual-property, personality or privacy rights, and promotion of crime. Users confirm that they hold the necessary rights and grant the Provider the non-exclusive rights required to store, process, deliver and display content within the service for the contract term.
9. Testing QR codes
Readability varies with print, material, size, contrast, damage, device, scanner and environment. Users must test every code and destination under realistic conditions before publication or printing. Universal readability on every device and in every environment is not promised.
10. Availability and changes
The Provider aims for high availability but does not promise uninterrupted access unless expressly agreed. Maintenance, security measures, network or third-party failures and force majeure may cause temporary restrictions. The service may evolve while preserving its main contractual purpose without unreasonably disadvantaging users. Material adverse changes to paid services will be announced in reasonable time.
11. Suspension and account termination
Content or accounts may be temporarily suspended for specific security risks, unlawful use, material breach or overdue payment. Where possible and reasonable, users will be notified and allowed to remedy the issue. Serious or repeated breach may lead to termination. Dynamic codes, redirects and published pages may stop working after termination. Statutory retention duties and the Privacy Policy remain applicable; users should export needed content beforehand.
12. Liability
Liability is unlimited for intent and gross negligence, culpable injury to life, body or health, liability under the German Product Liability Act, and an expressly assumed guarantee. For slight negligence involving an essential contractual duty, liability is limited to the foreseeable loss typical for the contract. Otherwise liability for slight negligence is excluded. Mandatory statutory liability remains unaffected.
13. Indemnity by business users
Business users indemnify the Provider against justified third-party claims arising from unlawful use or infringement for which they are responsible, including reasonable defence costs. Consumers are liable only under statutory rules and for culpable breach.
14. Privacy and service rights
The Privacy Policy explains personal-data processing. The service software, design, brands and Provider content remain protected. Reproduction beyond contractual use, circumvention of safeguards and abusive automated access are prohibited.
14.1 Optional precise GPS analytics
A QR-code owner may enable optional collection of a precise location. Before collection, QR ④ LIVE informs the scanning person on an intermediate page and requests both an express choice and the browser’s location permission. Permission is voluntary; if it is refused, fails or times out, the person is redirected to the destination without GPS. Availability and accuracy depend in particular on the device, browser, reception and the scanning person’s settings and are not guaranteed.
The QR-code owner may use this feature only for lawful and transparent purposes and must comply with any additional information or consent duties where the owner determines the purposes and means of further use. Covert location tracking, unlawful monitoring, personal movement profiles and inferences about sensitive characteristics are prohibited. The Provider may restrict or disable the feature where there are concrete indications of misuse. The Privacy Policy explains the data, legal bases, recipients and retention periods in detail.
15. Consumer dispute resolution
The Provider is neither willing nor obliged to participate in proceedings before a consumer arbitration board.
16. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection under the law of their habitual residence. Exclusive jurisdiction is agreed only where legally permitted, especially for merchants and public-law entities; otherwise statutory venues apply.
17. Final provisions
Individual agreements take priority. If a provision is ineffective, the remainder continues and statutory law replaces it. Changes for existing continuing contracts will be made only for an objective reason, transparently and with reasonable advance notice; mandatory objection and termination rights remain unaffected.
18. Google Wallet
Google Wallet is an optional, plan-dependent third-party feature. Availability is determined by the feature switch shown for the relevant plan. Users choose which of their own QR codes are provided as Wallet passes and remain responsible for titles, public destinations, required rights and the legality of transmitted content.
Use requires a compatible device, a Google account and the availability and approval of Google Wallet services. QR ④ LIVE is responsible for proper submission to Google’s interface, but does not guarantee continuous Google Wallet availability, a particular presentation, device compatibility or approval by Google. Google’s changes or restrictions may affect the feature. The associated QR code remains dynamic according to the plan; Wallet passes can be updated when added again and removed by the user from Google Wallet at any time.
